1. Security and Protection of your Personal Information
We consider it our priority to protect the conﬁdentiality of the personal information that you have shared with us and to protect it from any unauthorised access. Consequently, we employ state-of-the-art security standards in order to ensure maximum protection of your personal information.
As a company governed by private law, we are subject to the provisions of the European General Data Protection Regulation (GDPR) and the data protection regulations of your respective EU member state. In addition, Elysium complies with the Privacy Shield Framework agreement drawn up between the USA and the European Union. In doing so, Elysium undertakes to comply with the standards and requirements of European data protection law.
We have implemented measures at a technical and organisational level to ensure that the regulations and requirements relating to data protection are observed and upheld both by ourselves and by our external service providers.
2. Access Data
When you use our website solely for information purposes, in other words, if you do not register with us or provide us with any further information, then we will only collect the personal data that is sent to our server by your browser. If you wish to view our website, we will collect the following data that is technically necessary for us to display our website to you and to guarantee stability and security:
However, our web server stores this data separately from other data in the form of W3C web logs with an extended log ﬁle format, hence it is not possible for us to associate this data with any speciﬁc person. The information is used to monitor and manage the performance and reliability of our web server. In the event of suspected fraudulent activity on our website, these web logs may be used to verify the activities of an anonymous user.

If you make an enquiry or request using our contact form, only the personal information that you have provided will be collected and processed. The information that you provide in a contact request will be collected, processed and used solely to handle your enquiry.
This also includes the forwarding of this information to the internet service provider in charge of hosting our online presence. In this case, Elysium observes the principle of data minimisation. It shares only the minimum information which is absolutely necessary to process the enquiry. The information will also be used in order to communicate with you personally. Elysium does not forward your personal information to third parties without your express consent, which is revocable at any time. Elysium stores this information until consent is revoked.

5. Collection of Personal Data as part of Contract Conclusion and Payment
Personal data will only be collected to the extent that you voluntarily disclose this information during the order process or registration process. The following information is saved as part of an order:
Elysium uses this data solely for the purpose of execution of the agreement, and to communicate with you where necessary. This includes the initiation, conclusion, processing, guarantee, and where applicable, the cancellation of the purchase agreement. The information is retained until the purchase agreement has been executed in full. Where retention periods as stipulated by commercial and/or ﬁscal legislation are in place, the storage period can be up to 10 years.
This processing of data is based on the principle of Article 6, para. 1, pg. 1 letter a, GDPR, for the execution of the agreement.
6. Collection of Personal Information on Afﬁliates
If you register with us as an Afﬁliate, we will process additional personal data from you.
To conclude the agreement, we require the following personal information from you:
Title, name, address, email, telephone number, IP address, credit card number and expiry date, bank details, user ID and one or more of the following: Personal ID card number and or passport number, and a scanned copy of your personal ID card.
We also save your IP address and the date and time of your enquiry to allow us to detect fraud in a timely fashion.
This data processing is necessary for the establishment and execution of a contract as an Afﬁliate and is carried out on the basis of Article 6 Para. 1 Page1 Letter b GDPR. It also takes place for the purpose of safeguarding the legitimate interests of Elysium in accordance with Article 6, para. 1, pg. 1, letter f, GDPR.
For marketing purposes, Elysium processes the following personal information that you have forwarded to Elysium as part of your activity as an Afﬁliate, or for which you have voluntarily given your consent to Elysium for the execution of the contractual relationship: Name, country of residence, photo, head shot image, voice recording and your statement of recommendation.
This information will be used in marketing, advertising and training materials on the radio, on the internet, in the press, in television broadcasts (including cable and satellite transmissions) and in audio and video recordings. For this purpose, your personal information as listed above will be held for up to 7 years.
This data processing is necessary for the execution of a contract as an Afﬁliate and is carried out on the basis of Article 6, para. 1, pg 1, letter b, GDPR and based on the consent that you have given in accordance with Article 6, para. 1, pg 1, letter a, GDPR. It also takes place for the purpose of safeguarding the legitimate interests of Elysium in accordance with Article 6, para. 1, pg 1, letter f, GDPR.
As an Afﬁliate, you will also have access to the back ofﬁce “E.OS”. In this back ofﬁce, you will have an overview of the orders that you have placed. For this purpose, you will see the following data:
Order number, order date, Afﬁliate ID, name, products, order status, payment status, and shipping date.

You can also obtain a team overview in the back ofﬁce. Here, you will be given information on the Afﬁliates that you have acquired in your multi-tier sub lines. For this purpose, you will see the following data:
First name, surname, place of residence and country, user name, registration date, number of Afﬁliates, number of clients acquired, date of last login, time of last participation in a webinar, account status or cancellation date, and rank level of the Afﬁliate.
This information is only required for the calculation and traceability of your commission claims. The legal basis for the processing of this data is Article 6, para. 1, pg 1, letter b, GDPR.
To process commission payments, we require the following information:
Title, name, address and bank details.
You will also receive information here on the orders that have been originated by other Afﬁliates and/or customers. For this purpose, you will see the following data:
Order number, order date, order type, sum paid, name and address from shipping and billing information, tracking number and order source (originator).
This information is only required for the calculation and traceability of your commission claims. The legal basis for the processing of this data is Article 6, para. 1, pg 1, letter b, GDPR.
Due to the requirements of commercial and tax legislation, we are obliged to store your address, payment details and order data for a period of ten years. However, after two years we restrict processing, i.e. your data is used only to comply with the legal obligations. The legal basis for this data storage is Article 6, para. 1, pg 1, letter c, GDPR.
Furthermore, further to the complete processing of the contract, which also includes full payment of the agreed fees, the Afﬁliate's data will be deleted.
We forward your personal information to third parties only to the extent that is necessary to execute the contract or to safeguard our legitimate interests.
For this purpose, the Afﬁliates receive the following data from your enroller:
First name, surname and country of registration.
Your sponsor receives the following information:
Your ﬁrst name, surname, email, telephone number and user name.
This data processing is only required for the calculation and traceability of your commission claims. The information will also be required by your sponsor for your training and support. The legal basis for the processing of this data is Article 6, para. 1, pg. 1, letter b, GDPR.
We also use external service providers (data processors) for executing the contract. Separate data processing agreements are drawn up with these service providers to ensure the protection of your personal information. To carry out payment of your commission via wallet providers we pass on the following information:
First name, surname, place of residence and country, user name, email, a scanned copy of your personal ID card and a photo for identiﬁcation purposes.
This processing of data is based on the principle of Article 6, para. 1, pg. 1, letter a, GDPR for the execution of the purchase agreement and on Article 9, para. 1, para. 2, letter a in conjunction with Article 6, para. 1, pg. 1, letter a, GDPR on the basis of the consent that you have given.
7. Forwarding of Data to Third Parties
Customer data is forwarded to third parties only to the extent necessary for the purpose of contract processing. We also use external service providers (data processing companies) to execute the contract. Separate data processing agreements are drawn up with these service providers to ensure the protection of your personal information.
To carry out the delivery, the customer's ﬁrst name, surname, address, email and telephone number are forwarded to the shipping companies to enable them to complete the delivery.
To process the payment, the Afﬁliate's payment details, namely their ﬁrst name, surname, address, email, telephone number, date of birth, account details and IP address are forwarded to credit institutions or payment intermediaries.
For the purpose of early fraud detection, the following information on the Afﬁliate can be passed on to Accertify Inc., a subsidiary of American Express: First name, surname, address, email, telephone number, date of birth, Elysium account name, password, history and where applicable, notes that were added by Elysium departments, IP address, order details (including date, time, shipping costs, browser cookies, IP address, billing address, payment method, currency, failed attempts) and billing data (including invoice name, address, telephone number, card type, card number, CVV code, authorised amount and card expiry date).
This data processing is based on the principle of Article 6, para. 1, pg. 1, letter a, GDPR for the execution of the contract.

We wish to point out that the processing of your information that you provided in this context by third parties lies outside the responsibility and/or control of Elysium.

10. Use of Social Media Plug-Ins
Elysium currently uses the following social media plug-ins (hereinafter referred to as: plug-ins): Facebook, Twitter, Instagram, Linked In, WhatsApp, Google+ and YouTube.
To do so, the so-called two-click solution is employed. This means that when you visit the Elysium page, no personal information will initially be forwarded to the provider of the plug-ins. The plug-in provider can be identiﬁed by the marking in the checkbox above its initial letter or logo. Elysium offers you the option to communicate directly with the plug-in provider using the button. The provider of the plug-in will only receive the information that you have accessed on the corresponding Elysium page if you click on the selected area and it is then activated. The information listed in the "Access Data" section of this policy will also be transmitted. As the plug-in provider collects data mainly via cookies, Elysium recommends that you clear all cookies via your browser's security settings before clicking on the greyed-out box.
Elysium has no inﬂuence on the data collected or the data processing methods, nor are we aware of the full extent of the data collection, the purposes of its processing or the data retention periods. We also have no information on the deletion of the data collected by the plug-in provider.
The plug-in provider saves the information collected on the customer as usage proﬁles and uses these for the purposes of advertising, marketing, market research and/or for the demand-driven, customised design of its website. This kind of analysis is carried out in particular (also for users who are not logged in) to display demand-driven, customised advertising and to inform other users of the social network about the customer's activities on Elysium's website. You have the right to object to the creation of these user proﬁles. To exercise this right, you must contact the respective plug-in provider. Via plug-ins, Elysium offers you the possibility to interact with social networks as well as with other users, which helps us to improve and customise our offer and to make it more interesting for you as a customer.
Data is forwarded regardless of whether you have an account with the plug-in provider and are logged in to this account. If you have logged in with the plug-in provider, the data that we have collected about you will be associated directly with your existing account with the plug-in provider. If you click on the activated button and link to the page, for example, the plug-in provider will also save this information in your user account and share it publicly with your contacts. After using a social network, Elysium recommends that you log out regularly, however, especially before clicking on the button, as this will prevent any association with your proﬁle with the plug-in provider.
